Evidence – Character Evidence. Rudiments
The characterizers – who shall characterize them?
Shall they be characterizable? Chain of characterizers,
what shall be the length of it?
In English practice, if a man retains a bad
character, he it is because he is without influence, by
opulence or any other means.
If a constant and continually exercised habit
of lying for lucre is a just cause or token of bad character
in respect of veracity – i.e. of untrustworthiness in
respect of testimony, of no men perhaps who was so
discredited on the ground of bad character in respect of
veracity was the character ever so bad as that of the
least bad Judge that ever sat upon an English Bench
and of all Judge's characters the worst would be that of
the head of them all – the Chancellor, the conduct encourages suborns
of mordants, who will not so much as profess
to give justice to a suitor in the character of plaintiff, till
he has defiled himself by a letter written of his and duly thus forced
into his pen by that pretended universal Guardian of morality public
morals.
As to Character evidence care should be taken not to admitt
