Penal Code.Ch. Division of Offences
As often as for the sake of some benefit real or
supposed to the public service a proposition made for
taking out of the possession or expectation of any person any
benefit of which he is regarded as being in possession, disapprobation
with or without an exception in case of the grant of
an equivalent is sure to be expressed felt, and to that expr feeling
the sentiment expressed in some form of words or other is sure to be
given. But by this form of words what is it that is expressed?
In some indirect awkward and inapplicable
way the relation between the possession and the subject matter of
possession: but never the effect of the proposed change upon
the feelings – and conduct – upon the faculties passions and
action of the person interested the person whose interest is operated
upon and affected.
To this purpose head belongs the expression of which in
English practice is so frequently presenting, so often presents itself the expression composed
of the words vested rights: of pertinents and passion
a quantity more or less considerable according to the condition
assumed by the tone, loudness of intonation, countenance, gesture and deportment
is on those occasions expressed of course: of reason for all this
not a particle. So in case of oral discourses and in case
of written and quasi-written discourse peculiarly in magnitude
of type might be employed in comparison as equivalent
or at least a substitute for loudness of intonation.
