1. Appeal -warranty function
In English bred law as in these cases no Appeal
in any termscondition court has place: whatever security it would afford
against misdemeanour by punishment of the criminal is therefore
under that system in this case wanting. On the other hand to the purpose of
correction and thence imbrev of punishment the time of
the Jury is altogether . One good consequence is that
for corrective punishment an individual is extremely rare:
