eye is drawn to the subject, and the tutelary power<lb/>
of <add>the</add> Public Opinion Tribunal is occupied in obviating<lb/>
the misexercise of it:  when it is in any of the above-mentioned<lb/>
indirect ways that the effect is produced, the<lb/>
security against evil is wanting.</p>
<p>Exception excepted, by this observation condemnation<lb/>
is passed on every indirect mode of producing this<lb/>
same effect.</p>
<p>The exception is – where by popular <add>error</add> prejudice<lb/>
a desire is kept up to witness the punishment this or that<lb/>
species of action by which either no evil at all, or none<lb/>
but what is <gap/> by concomitant good, or by the<lb/>
evil which <del><gap/></del> in the shape of punishment would be necessary<lb/>
for the suppression of it:  <del>In this case</del> as for example<lb/>
where under the delusions to which the weakness of human<lb/>
understanding is exposed, produced or strengthened by<lb/>

is to say an opinion different from the opinion entertained<lb/>
or professed to be entertained by him who with impunity<lb/>
to himself has the power of producing suffering on the part<lb/>

Instructional Ratiocinative

When it is by an act exercise given to the power of the Justice Minister
that the effect is produced, the attention of the public
eye is drawn to the subject, and the tutelary power
of the Public Opinion Tribunal is occupied in obviating
the misexercise of it: when it is in any of the above-mentioned
indirect ways that the effect is produced, the
security against evil is wanting.

Exception excepted, by this observation condemnation
