Procedure CodeCh. Nullification

thus addressed has the temerity to give expression his acceptance
to a conveyance, which, upon looking over
the abovementioned list of authorized species
of conveyances, he finds not to be contained
in it, giving money in return for it, and the
result is that the right he thus attempts to
acquire does not remain to him, and the
money he parted with for the obtainment
of it is lost to him, he has himself to thank
for it, he and he alone is to blame.

But if so it be that the legislator,
after making an enactment by which all conveyances
not comprised in the list of those
to which he has determined that validity, i.e.
the effect purported to be intended by
them, to be given to them, has omitted to
make the arrangements necessary to lodge
in the minds of all persons who are in the
way to accept of conveyances, it is on the
Legislator that the whole blame lies and
not on an individual: the law is a trap,
laid by the Legislator – a trap into which
all individuals who are in the condition
just described live during their whole lives
in the danger of falling.

But everywhere Legislators have been
either themselves lawyers, or in confederacy
with Lawyers, whom, for the facility derived from
them in the practice of depredation and oppression,
they have let into a share, more or
less considerable, of the profit and advantages in all shapes &c
