Procedure CodeCh. Nullification

Unfortunately in English practice, this
is a supposition, and nothing more – a
supposition that never has as yet been verified,
nor as yet seems to be so much as
in a way to be verified: certain species of
conveyance having been in use, and the
Judges having upon application in the
established mode made to them between
in use to give effect to these same conveyances,
individuals who, on this or that
occasion, became desirous of engaging
in this or that species of conveyance,
have been left at their peril to learn,
from the high paid opinion of their professional
advisers, to determine for themselves
whether the conveyance in question
was or was not in a sufficient degree
similar to those by which allowance
had been received, to possess a sufficient
probability of receiving the like allowance.

☞ Pass over for the present the case of contracts,
differing little from that of conveyances – Go now to
the cases of acts and instruments of Procedure.
