a right, suppose, is conferred by an appropriate<lb/>
 
portion of the law:  a right say, to remedy in<lb/>
a certain shape for a wrong in a certain shape<lb/>
in the event of it's being done.<add>By the Legislature,</add> To the enjoyment<lb/>
of this right, no condition is annexed:  what is<lb/>
ordained is that in whatever case or instance<lb/>
the wrong in question has been committed on<lb/>
one part, sustained on the other, the remedy in<lb/>
question shall be applied:  applied, to wit, by that<lb/>
authority, the judicial, on which the power of applying<lb/>
it has been conferred, and the <del>duty</del> obligation<lb/>
of applying it professed, at least, to be imposed.<lb/>
With this command absolute and unconditionalized<lb/>
as it is before his eyes, the Judge,<lb/>
on application made to him by an individual<lb/>
by whom the right, as above, had been given,<lb/>
instead of paying that obedience as it was his<lb/>
duty to pay to the unconditionalized ordinance<lb/>
of the Legislature, attaches to it conditions of his<lb/>
own to the effect, as he well knows and intends<lb/>
of frustrating it.  What other intent can he have<lb/>
had?  The condition, he sees has not been fulfilled.<lb/>
How should it have been fulfilled?  Answer.  The<lb/>
fulfilment was in the nature of the case impossible?<lb/>
Well – and what was it that rendered it<lb/>
impossible?  It was even this – that <add>by</add> the very man<lb/>
by whom the condition was imposed, care was<lb/>
taken that the fulfilment of it should not be<lb/>
possible.  To pay obedience to a Law, what is<lb/>
necessary, is that the man in question should<lb/>

Art. To an individual of a certain description,
