Now comes Evil 5. When If The evidence is liable to be irrelevant or
frivolous.
For the production of this effect any one of a variety
of causes is sufficient. As for example
1. On examination by the Attorney, the supposed percipient
witness in question, eager to contribute his assistance to
the party, gave to his statement a colouring of importance. At the trial
the fear of the penal consequences of misrepresentation, he
corrected it, and reduced it to tis genuine insignificance.
2. On examination, the evidence equivalent
was the importance of the evidence even in the eyes
of the Attorney to whom it was delivered. But if the
importance of the evidence was equivocal, the unequivocal
was the profit that would be made the result of the
addition made of this article to the aggregate mass of
evidence.
Suppose it ever so trivial, or even altogether
irrelevant. Useless To the party to whom everything
that passed on the occasion was unknown how should
the put upon him by the addition of this part of
the expence be detected?
