<p>Art. 8.  If on the exhibition of a certain document,<lb/>
 
its authenticity being supposed, it be clear to<lb/>
the Judge that the demand on the Pursuer's side would<lb/>
be established, at the same time that the adduction of it<lb/>
will require a certain portion of delay or expense, or both,<lb/>
he may at his discretion, decree provisionally in favor<lb/>
of the demand assigning a certain term or say interval,<lb/>
at the expiration of which, if the document<lb/>
be not exhibited, the decree shall be considered<lb/>
as reversed;  reserving to himself the faculty of enlarging<lb/>
it on adequate cause.</p>
<p>Art. 9.  In such case, he may moreover give<lb/>
execution and effect to such his decree on the<lb/>
Pursuer's finding adequate security for restitution<lb/>
and compensation in the event of the non-exhibitedness<lb/>
or non-probativeness of such unexhibited<lb/>
document.</p>
<p>Art. 10.  So mutatis mutandis in the case where<lb/>
it is on the Defendant's side that the need of the document<lb/>
has place.</p>
