Procedure Code
For The inhibition demanded may be principal or

If punishm the case be such that over and above the evil sustained invoked
as above in the affording of satisfaction, evil in the name of
punishment has by the substantive has been regarded as necessary
and is accordingly required ordained to be demanded by the Agent
of the government, the case may in conformity to general usage
be termed in consideration of the nature of the forbidden act a criminal one, and in consideration of
the punishment attached to it a penal one, and if no individual
be there be no individual whose interest is afforded
by it more than that of another, a purely public one.
If it be such that while in consideration of the evil
produced by the mischievous act in the breast of the individual
wronged it creates a just proper demand for satisfaction, it creates
either by the inability of the delinquent to afford the
