Cases where the epistolary mode at a post-originative
Judicatory defendants immediately all backed or where would be the most clearly conductive to the ends
of justice.
Seldom will a case of this sort be likely to occurr
As to the four species of the suit in regard to the eligibility
as between one and other another of the four modes
of eliciting responses, the difference between one another
of the four species of suit will not scarcely be found a
variation any such differences as should influence the
choice. The cases where in the for eventual compliance
and reddition of the service demanded preliminary
security in any shape at the charge of the defendant
is requisite, has it already been disposed: and
where no need of any such compulsory security has
place, the migration on the part of the dependant to the seat
of the judicatory being for the purpose of security by the
supposition needless the objection to the use of the interrogative epistolary
mode of interrogative and responsive preference in contradistinction
to the epistolary mode will not be strong
in the case of a penal case, which purely public
or publico-private, than in a non-penal case
particularly when it is considered that in those non-penal
cases, those which are inculpative were included.
