§. Undue iteration of app pursuit how obviated.

Art. 1. To obviate vexation endeavour on the
part of an applicant to elude the effects of a dismissal
unappealed from, a question question as to which the Judge before he
receives the an applicant in the character of a pursuer or pursuers
proxy will examine him are the following.

Question 1. Have you, at any and what time, had
any suit or suits, and if yes under what name depending or commenced
carried on – in any and what judicatory or judicatories in relation to, or any and what way connected
with the demand you are now making, with the
same or any other and what parties?

Question 2. If yes, are such suit or suits respectively
terminated, and in what way, or still depending, and in what
stage and state.

Art. If, at the hands of the same pursuer in consequence of a demand made in
relation to the same matter in another judicatory has by from
that such other judicatory or any Judicatory to which by such first
judicatory it was transferred received a dismissal whether
on Appeal or without Appeal made, the Judge will if he sees reason
punish the Applicant by fine for undue vexation by wasteful consumption
of judicial time.
