Procedure CodeCh. 1. Stages of Procedure
§. 2. Initiatory application
(1)
An applicant is at liberty to bring with him any
number of persons in any number in the character of applic
co-applicants or witnesses. But then will all of them be exposed subjectible
to counter interrogation to on the Defendant's side.
(3)
Employed this under III Appellate
Whereas by accident or design when a after the
at the stage in question a certain Judge has had a hearing
of the suit in question, a different Judge has a second hearing
of it, this may eventually have the effect of appeal
and this forms another stage. But this is no more
than of necessity is liable to happen under any system of
procedure, and the place being the same the vexation of a
second hearing for before a different Judge will not be greater than
if it were before the same Judge.
(2)
A case in which hearings in unlimited number
may require to be given to an applicant before a determination
is taken whether to constitute place any and what individual in the on the
Defendant's side situation of Defendant is that in which the applicants though
need of investigational enquiry has place: where for the obtainment
of employable evidence, evidence simply indicative of
the existence of employable evidence, and not itself employable
must be heard.
This need is what most frequently has place in penal
cases but may have place in any sort of case.
