<p><foreign>Idus üsdem, verba eadem</foreign> – thence that language most<lb/>
 
<hi rend="underline">apt</hi> which affords the richest set of <hi rend="underline">conjugates</hi>.</p>
<p><hi rend="underline">Latin</hi> does this.  Greek, Latin and Teutonic the <del><gap/></del> <add>radical</add><lb/>
languages of the most civilized nations.  Latin most apt<lb/>
for politics and morals:  Greek, for physics.  English, the<lb/>
most apt Latin-sprung language, <del>as being the most simple<lb/>
and <gap/> in its texture and most <gap/></del> as possessing in<lb/>
the highest degree the aggregate of those <hi rend="underline">appropriate</hi> qualities – <hi rend="underline">simplicity of texture</hi>, ductility and augmentalility.</p>
<p>Each branch of law will have it's appropriate mass of<lb/>
language:  Constitutional, as being the first in order, <del>which</del> <add>must<lb/>
be the first to employ what</add> belongs to <hi rend="underline">happiness</hi>.</p>
<p>Under Constitutional object or <hi rend="underline">End</hi>, put what belongs<lb/>
to <hi rend="underline">happiness</hi>:  it's relation to felicity, pains, pleasures, interests,<lb/>
desires, motives.  Reference to S.B.'s "Springs".</p>
<p>A good Code ought to be it's own <hi rend="underline">Institute</hi>:  <add>it ought</add> to supersede<lb/>
all demands for every other.</p>
<p>Masses belonging to Constitutional Code <add>are –</add> 1. Happiness.<lb/>
2. Location.  3. Aptitude.  Ends general and specific.  Law<lb/>
administers pain <hi rend="underline">directly</hi>:  not pleasure:  it puts the <hi rend="underline">instruments</hi>,<lb/>
or leaves them, in men's way.</p>
<p>II.  To <hi rend="underline">Penal, Misdeeds – Punishment – Compensation –</hi><lb/>
Circumstances – Aggravation – Extenuation – Exemption.</p>
<p>III.  <add>To</add> <hi rend="underline">Civil, Rights</hi>.<lb/>
(But these must have been brought to view under Penal,<lb/>
Contracts – Conveyances.</p>
<p>IV.  <add>To</add> Procedure – <del><hi rend="underline">Evidence – Extraction of Instruments</hi></del> <add>Main object of <del>Evidence</del> Procedure,</add> of<lb/>
Forthcomingness <add>or person and things</add> for justiciability and <add>or</add> testification.</p>
<p>Imperfection of language in general in relation to this<lb/>
<del><gap/></del> <add>part of the field.</add>  Terms neutral – eulogistic, dyslogistic.  Ambiguity<lb/>
same name for <hi rend="underline">operation</hi> and <hi rend="underline">result</hi>.  Illusory collocation.</p>
<p>Connected and consistent with a Code of Law ought<lb/>
to be a d<hi rend="superscript">o.</hi> of Morals.  Law acts by creation of factitious motives.<lb/>
Morality, by indication of naturally-existing ones.</p>
<p>Of what is done towards fixing the import, or augmenting<lb/>
the stock of the appropriate part of the language which must<lb/>
be the <hi rend="underline">place</hi>?  Answer.  Either these Preliminary Explanations,<lb/>
or the <hi rend="underline">Expositive</hi> part of the Code, or both:  the Expository part<lb/>
of the Code fixing the import of the leading terms and phrases<lb/>
as they occurr:  the Preliminary Explanations laying down<lb/>
