Constitutional Code.

For application of this purely moral power, publicity
of the proceedings will might in proportion to the extent given to it, suffice.

Considered with reference to any individual judicial setting
taken by itself, this extent will have for its measure in the first
place the number of the individuals to whose cognizance the proceedings the matter of discourse
in question is brought in an audible form alone at the moment of
utterance; in the next place the number of those to whose cognizance
it is afterwards brought in a visual and permanent form by written discourse.

Inconsiderable it is evident, in comparison of the utility importance of that
of the visible and permanent form is the utility usefulness in this respect of that
of which communication is received in no other than the audible
and evanescent form: inconsiderable both in respect of security for correctness
permanence, and capacity the extent of the communication they are respectively susceptible
of as measured by the number of the readers.

On the other hand the impression made by discourse when as
it passes immediately from the lips to ears is more lively than that of
the same discourse when conveyed to the mind in the silence of the through
the medium of the eye.

Still however the so inconsiderable is the greatest number of those to
whom conception of it can in this shape be afforded of it in the evanescent shape in comparison of
the greatest number of those to whom it is capable of being afforded
in the only permanent shape, that it is principally, on account be means
of the security, afforded for the correctness of the copy, afforded in of a
writing when the existence of such copy is secured, that magnitude
in respect of the number of the hearers is a matter of importance:
is when no such permanence is rendered regularly certain,
the additional any such probability as that magnitude may be
regarded as affording in favour of the performance of the several operations
by which permanence and diffusion are given to the mass of
discourse in question, whatever it may be.

Hence the monetary rule, the smaller your Justice Chamber, the
greater if the ends of justice be your objects will be greater ought to be your care, that published reports may not be wanting, and that
by the adequacy of it and commodiousness
