Oral mode best adapted
to the ends of justice

2. Whatsoever be the state of the proposed Defendant's
mind in respect of sincerity, this of the his mode of dealing holding
intercourse with him this is the one best adapted conducive to the ends of
justice. If the state with respect to the his desire is to receive the decision of the Judge it is in this way that,
whether for the coming to an agreement, or the settling the
plan and mode of discussion, the minds of the two parties
will be most promptly speedily and completely laid open to each
other and to the Judge, and the grounds on which his decision
requires to be founded settled. If the insincere state
that is to say if
his desire be to stave off so ultimately
to elude the decision of the Judge, it is in this
way that the sinister desire may be most promptly and
effectively frustrated.
