<p>By the consideration of the remedies will <add>therefore</add> be <gap/><lb/>
<gap/> for <hi rend="underline">subject</hi> matters of consideration.</p>
<p>On the occasion of Offences affecting the body<lb/>
distinguishable subject matters of consideration are the<lb/>
following:<lb/>
1.  The maleficent act:  and whether positive or negative.<lb/>
1.  Its <del><gap/></del> nature:  2. its duration.  See Offences D.1:  Ch. Offences transitory and continuous:  by <gap/>, quasi continuous.<lb/>
2.  The maleficent effect.<lb/>
3.  In the case of the body, the <hi rend="underline">part</hi> affected.<lb/>
4.  The maleficent instrument.  Refer to B.1. Ch. V.<lb/>
5.  The ultimate effect intended whether the one produced or a<lb/>
different one, if a different one whether a maleficent neutral or beneficent on, if maleficent<lb/>
whether in the same degree<lb/>
in a greater degree or in a<lb/>
less degree, if beneficent<lb/>
one whether the preponderance as between the<lb/>
effect intended &amp; the effect<lb/>
produced be on the side<lb/>
of maleficence or on the<lb/>
side of beneficence<hi rend="superscript">⊞</hi><lb/>
<hi rend="superscript">⊞</hi> Note here that on the effect produced <gap/> <del><gap/></del> is<lb/>
proportion to the evil of the 1<hi rend="superscript">st</hi> order on the effect<lb/>
intended the evil of the 2<hi rend="superscript">d</hi> order.</p>
<p>Antecedently to the maleficent act<lb/>
1.  The maleficent design:  the maleficent effect intended<lb/>
or not intended:  if intended, intended as one and, a means or a collateral effect.<lb/>
2.  The maleficent preparation or preparations<lb/>
3.  The maleficent attempt or attempts<lb/>
4.  The <add>efficient</add> motive or motives constituting in the aggregate<lb/>
{Refer to Offences collateral, <gap/> in <gap/>}</p>
<p><del>the</del> <add>(b)</add> inducement:  viz. 1. self regarding: as in case of homicide<lb/>
for self <unclear>preservation</unclear> or for <gap/>:  or antisocial, as in case of homicide for <gap/>, or <gap/>, as in<lb/>
case of homicide for<lb/>
preservation of a<lb/>
person <gap/></p>
<p>5.  The counter-motives the tendency of which has<lb/>
been to prevent the maleficent act by preventing the<lb/>
prosecution of the maleficent design.</p>
<p>The motive not being plainly as to self regarding, antisocial or<lb/>
social, the efficient cause of the maleficent <unclear>acts</unclear> may have been <gap/>:<lb/>
<gap/> of that <unclear>due</unclear> attention which if bestowed would <gap/><lb/>
<unclear>prevented</unclear> the act.  Exempt Orders be a wrong by Army Minister.</p>
<p><hi rend="superscript">(a)</hi> Note that where the act is negative the evil of the 2<hi rend="superscript">d</hi> order<lb/>
is scarce in any instance near so great, as where the act is of the positive stamp.</p>

By the consideration of the remedies will therefore be
for subject matters of consideration.

On the occasion of Offences affecting the body
distinguishable subject matters of consideration are the
following:
1. The maleficent act: and whether positive or negative.
