Penal from Constitutional Code

Exposition

Art. By R. the recipient functionary
the information will have been received either in the oral form
or in the written. Suppose it received in the written form, and
not immediately from P. the alledged percipient witness, the signature of that same witness being known to him, number
of rumours or rumours are and no more than one. As who by
whom the information is communicated orally to R. will, according
to his statement have received it from P. to wit either orally or surreptitiously:
if surreptitiously say by letter to him, addressed by P.. If in this case if surreptitiously and he
shews the letter to R. the signature of the letter writer being known to R. then is there no grade interposed between
the recipient R. and the alledged percipient P.: the alledged percipient
is moreover also the immediately reporting or say narrating witness.
But instead of producing the letter and shewing it to R. what A. does
is to report to R. the alledged contents of this same letter: here
between R. and P. is a or grade of evidence interposed
and thereby as above the trustworthiness of it to a person viewing
it from the position occupied by R. diminished. So also, though
in a less degree, if although he shews the letter to R. if to R.
the signature of the alledged letter writer is unknown, and his
belief in the authenticity of the letter has no other support than
the allegation made accordingly in relation to it by A. In
this case the diminution of trustworthiness is considerably less than
if A. instead of producing and shewing the letter had spoken of it as if from
no other source than the having seen it in the hands of another
person, is after having had it it in his own hands transmitted
it into otherwise without having seen it since.
