Dispatch Court BillBill. 1. Judiciary
§. VI. Judges Power &c Self-suppletive
Ratiocinative or Note continued
When on the occasion of the charges produced commenced under Lord
Grenvilles administration Aº1806 in the Judiciary
Establishment of the Scotch Supreme Court the Court of Justice
that judicatory being was cut in two. Sir Hope
rather than submitt to be bereft of half the power of
which he had been want to exercise the whole, divested
himself of the whole.
To the thus dispirited functionaries the nature of the case
admitts not of the furnishing adequate satisfaction for the loss,
for the for the pecuniary loss adequate compensation would be
too much for to ask for, for the loss in power and consideration,
no compensation in that or any other shape could be
administered: the foundation of all the in which
they are held out from under thus the sources of the
of veneration that been at all times and on all occasions
bestowed upon them dried up and then to have been no
better than a compound of mischievousness and absurdity in both
these articles more abundant than the breach of the
languate – the coat of thieves, pointed out held up to view and by the
highest authority – that of Parliament, as a source of
misery so abundant as notwithstanding so vast
a mass of difficulty at all times standing in the way of removal to
have become at length intolerable.
In this state of things, nothing can be more natural
not to say certain than that to effect the frustration of the whole charge
all . all powers operations and all operatives should
be set to work, all means direct and indirect, conspicuous
and secret employed: and that when they by wayward industry
the effectuation of the design when they by wayward industry has been accomplished, it should
be pronounced naturally and intrinsically of
impossible. And when this first attempt has produ proved
, what then will how in that case will be the probability
of any effectual remedy in : the failure of the first attempt will
be a plea in to every failure . Look it will be seen to experience
by proved to you that the thing is absolutely impossible.
