As to the furnishing or withholding information belonging to the above
heads the Judge will be determined by his opinion on the question
whether it would be in the greatest degree upon the balance conducive
or preventive to the with reference to a right conclusion respecting the
facts matter of fact belonging to the suit: conducive by either and given to honest sincere resolution;
preventive by and given to mendacious invective and oppression

No rules more particular can with propriety be given

Scarcely with propriety can any more particular rules
be given. Feigned Examples might be multiplied without end. What had
best be expressed what withholden will in each individual case depend
upon the individual circumstances of that individual case.

In case of doubt where the defen individual place of
habitation if any is at the time, or his ordinary place of habitation
being known where in what exact place he is at the time whether residing
or on a journey it may be necessary or construed useful to ad
inclose, an exemplar of the hither-calling mandate addressed to the intended witness
in an appropriate mandate addressed to the Local Headman of
the Bissubdistrict or Trisubdistrict in which it is supposed that
at the moment he is likely to be.
