1826. April 22
Penal CodeCh. IV Offences – title to property
§.
Corresponding and contrasted with non collation,
will in this case be collation. But as the thing
conferred is a burden, the word collation not being
in use to be applied to any object that is not considered
as beneficial, would not appear apposite. Instead
of collation say then in this case oneration oneration, by
which word, the creation of the obligation and the
burdensomeness of its nature is at the same
time indicated.
2. Correspondent to, and contrasted with
ablation is not excruciation. The thing taken away
being still a burden as before.
3. Directly correspondent to and contrasted
with usurpation – none – if the thing in question
be considered in the light of a burthen it will
not be usurped it will on the contrary be the
endeavour of him upon to whom it is by law
conferred to rid himself of it. Hence the
offence of wrongful self exoneration which
will in the same manner have no correspondent
when the thing conferred is considered in the
light of a benefit.
4. Correspondent to and contrasted
with transference is transoneration. The
thing transferred being still a burthen as before.
