<p>Aggravation.  In the import of this word,<lb/>
there is something of ambiguity.  Aggravation?  Of<lb/>
what?  Subject matter of it, what?  The mischievousness<lb/>
of the offence or the quantity of punishment demanded<lb/>
by it for the subsequently preventive remedy.</p>
<p><add>Under the greatest happiness principle,</add> In no other character than that of a justificative<lb/>
cause of addition to the punishment in it's<lb/>
ordinary state, can aggravation be an object worth<lb/>
considering;  but it was under the dominion of the<lb/>
principle of sympathy and antipathy that the word<lb/>
aggravation and the idea attached to it, sprung up,<lb/>
and in many cases, the question as to the existence<lb/>
of a cause of aggravation amounted to this. By<lb/>
the consideration of the circumstance in question,<lb/>
do you feel your antipathy to the offence<lb/>
and the offender in any and what degree more<lb/>
strongly excited.</p>
<p>Thus it is, that to say of the circumstance<lb/>
in question, that <del>it ought to be employed</del><lb/>
it ought to be considered as a circumstance<lb/>
of aggravation, is in ordinary language as much<lb/>
as to say that, in consideration of it, addition<lb/>
ought to be made to the quantity of punishment<lb/>
allotted to the offence in it's ordinary state.</p>

Aggravation. In the import of this word,
there is something of ambiguity. Aggravation? Of
what? Subject matter of it, what? The mischievousness
of the offence or the quantity of punishment demanded
