Constitutional Penal Code

Ch IV
Offences affecting title to property
§. 1 General observations.

Offences affecting title to property assume a different
character according as the subject matter of them is
in use to be transferred from proprietor to proprietor, without
deed as the customary law language phrases it, or
not without deed, but by deed. To the first class belong,
for the most part, those which come under the denomination
of moveables things moveable. To the other, those which come
under the several denominations of things immoveable and
things incorporeal.

Offences concerning title will be found comprehendible
all of them under the six following the
denominations. 1. Wrongful non collation of title to
property. 2. Wrongful ablation of ditto. 3. Wrongful Usurpation
of ditto. 4. Wrongful transference of ditto. 5. Wrongful
interception of ditto. 6. Wrongful depreciation of ditto.

Of Title, for the most part, the efficient cause is
some act of man, though in some instances as will be
seen the effect is produced without the intervention of
man by the hand of nature.

In the cases where the property passes not
otherwise than by the act of man, and at the same
time, by deed, the subject offence will have for its subject
matter, a tangible instrument, an instrument of
conveyance styled a deed, an instrument by which the property in question is in general conveyed
from one person interested to another.
