Preface?
Equity procedure

60 or 8
Defendant's statement,
on oath, plaintiff's not

What the plaintiff is made thus to say is not — [must
not be] upon oath: it must not be: if it were all this compulsory falshood with
the profit upon it would be lost lost to the whole confederacy of Judge and all his partners
lawyers. On the contrary What the defendant is made to say is [and must] be upon
oath: it must be, if it were not, the supposed necessary security
for the truth of the statements thus elicited would be wanting:
[and the judgment whatever it were that should ever have been pronounced
by the Judge would be destitute of all ostensible grounds]
All this while, no evidence whatsoever is elicited from any
extraneous witness: nor from a party or parties on more than
one side. To compleat the elicitation of party's evidence and
there mu an additional suit is made necessary, and this
Bill by from which the second suit in relation to the same demand
receives its commencement is termed a cross Bill. The

Cross Bill what

mendacity license now changes places. The party upon
whom in the situation of plaintiff the part of the liar was
formed for the purpose of on the occasion of and for the profit upon the original Bill, is is forced to
make his appearance in the character of an honest
man. On the occasion of the original suit he would have
been punished if he had not told lies: on the occasion of the
second suit, the individuals who by the Judge had been
forced to utter this boundless aggregate of lies is
made punishable of his gross utterance to so much as a
single one, in the first case the punishment is the rejection
of the demand: s loss of money or moneys worth to the
amount of hundreds of pounds thousands or millions as it
may happen: in the first case, fine unbounded imprisonment, internment,
transportation, or all of late years pillory. Before the evidence
of these two parties has been checked, the proceedings on the original
Bill may have been spun out through any number of years
those on the cross Bill to an additional number of years.
