26) Personal Injuries. Inserenda.

Injuries ignominious — Why apt to be punished less than they deserve the affection of Anger to get in to keep footing, subsist when
once the sentiment of ridicule has got footing.
In such a case, when I see a Judge laugh, [laugh] give
way to laughter especially if the parties themselves it is at the parties, or
that cause be the objects, I must confess I [am apt to entertain]
have little expectation that Justice will be
done.

In point of experience, I believe the punishment is generally
found to be correspond to the disposition as here [here depictured.]
represented of those to whom it belongs to settle it.
A man has his leg broke An injury of the acute kind such as the breaking
of a limb, shall excites as it ought the serious indignation
as well of the Judges as of the audience.
A fine of two or three hundred pounds perhaps
if the prosecution be by Indictment, or damages
to the same amount, if by Action, will not be
thought too much. for b Let a man get pulled
by the nose, though he be of the rank of a Gentleman,
and though it be do the outrage have
been offer'd him in a public company [,what
is the consequence?] the Judges and audience make
themselves merry at his expence, and 40s perhaps
or £5 pays if the author injurer made to pay
40s or perhaps 6£ it is as much as one should expect.
[ Yet if we aestimate the amount of the mischief in
the two cases by the unwillingness of the party
concerned to undergo incur it, [I believe we shall find
few persons of the rank of Gentleman at least who
would not prefer the former rather submitt to the former outrage than to
the latter] Yet nothing can be more disproportionate than
