Per Lord Camden - "Discretion the law of tyrants" his rant against DiscretionDiscretion arbitrary
The strongest attachment to arbitrary judicial power, consistentnot disproved
by this rant.
It being therefore the Of every Judge and
of every lawyer to whom it can be matter of expectation
to see either himself or any friends of his in the
station of Judge, it being thus the interest that the
power of Judges should to the greatest extent possible
be as ab arbitrary that is as compleatly out of
the reach of all checks as possible, if by any lawyer
any opinion be ever seen to have been from
the effect of which is to represent arbitrary power
in such hands as a fit object of jealousy and
a fit subject for retribument , such declared opinion
would be seen to be deliveredto stand in certain respects in opposition to the official one professional
and thence to the personal interest of such
Judge, and in that accusant so much the
less likewise likely to be insincere, that is opposite
to his real oneopinion.
