The general propriety
of such
powers is not
open to dispute
and has been particularly
put out
of dispute in
the present instance
by his
successive Acts
As to the propriety of taking ground by
compulsive powers for the such a purpose as that
in question, it is a point not no longer open to controversy dispute,
having been twice already affirmed twice over divided upon by
the legislature on this very occasion in relation and decided in the affirmative
in relation to the particular purpose here in question, once by the original Penitentiary Act
29. Geo. 3 ch 74 and again by the Penitentiary
Contract 34 Geo: 3. c.84. which
it is the object of the present Bill the informing
and amendment of which is the object of the
present Bill: [the object principle of which latter is not to
give the stronger power, but to mollify the
exercise of powers already given, by transferring
it as far as may be, from the Lands
in separate ownership already provided at
Battersea, Lands which from their situation
naturally would be, and in experience have
proved to be a spot in relation to which
the pretium affectionis has been found to
operate as it well might be expected to operate
with more than ordinary force, to an ill-famed
and desolate spot valuable to nobody
the property of which being in point of right every bodys property
is
