<p><pb/>Provided always And be it further Enacted that if<lb/>the said Dean and Chapter should in preference to the absolute Conveyance<lb/>of the said lot A or their Interest therein <sic>chuse</sic> rather to convey the<lb/>same in the the way of Lease for a long term of Years (at a <unclear>peper com</unclear><lb/>or other reserved rent) with or without the further consideration of a fine<lb/>or fines payable at certain or contingent Periods and the Persons so<lb/>appointed to treat on their behalf as aforesaid shall make such his<lb/>Election by giving to the Lord High Treasurer or Commissioners of the<lb/>Treasury notice thereof in writing within one Calendar Month after<lb/>notice shall be given of the said Spots being so fixed upon for the<lb/>purposes of the said Act Then and in such case it shall be lawful<lb/>to and for the said Lord High Treasurer or Commissioners of the Treasury<lb/>at his or their discretion and only in case he or they shall think fit<lb/>to accept of such Lease from the said Dean and Chapter (the same<lb/>being duly confirmed by the said other Parties and their Rights bound<lb/>being for a term of less than a thousand Years.&#x2014;</p><p><lb/>And whereas ever since the institution of his Majesty's<lb/>School at Westminster founded by Queen Elizabeth of Glorious Memory<lb/>the said Waste <sic>hath</sic> under the authority and by the allowance of<lb/>the said Dean and Chapter and without any restriction as to any<lb/>particular thereof been accustomed to be made use of as a place of<lb/>Exercise and recreation for Cricket or other Sports requiring a large<lb/>extent of Ground to the amount of several Acres, by the Scholars of<lb/>the said School, and the said Scholars would be deprived of the said<lb/>benefit if Provision were not herein made for the continuance of the<lb/>same in the Division and Appropriation of the said Waste.&#x2014;</p><p><lb/>And whereas the said Waste is <sic>intirely</sic> open and situate<lb/>in the Neighbourhood of many mean Houses and is exposed to<lb/>the Promiscuous resort of mean loose and disorderly company and<lb/>therefore the allotment of a competent separate and <sic>inclosed</sic> Spot of<lb/>Ground<pb/>
