As to the difficulty first mentioned I know of no other
method means of getting over it, than for the Legislature
to have recourse to the operation of assessment, and fix
how much a head shall be deemed as much as can
be wanted for the consumption of the family so that
all above shall be deemed sent in to be retailed
for profit. Whether the difficulties attending this exp operation
may not be such as may render it preferable
to abandon the regulation altogether, is a question I shall
content myself with proposing. Thus much However may be observed
that the actual want of Publican's making the actual retailing & that without a license a
necessary condition to the conviction of the Brewer, will dipense with
a great deal of that nicety that must otherwise be observed.
