Art. 63. Proportioned to the encrease which it is in that the
power of the functionary to give to the value of his remuneration
without so much as equivalent encrease to the value of the service
produced by it in the degree in which his interest is then
rendered opposite and adverse to his duty: the degree in which his
violation of his duty is likely to be carried the magnitude
of the evil which (the power and influence attached to his
situation being given) is likely to produce.
Art. 64 Cæterus paribus, that is to say the abovementioned
circumstances being the same or equal, the quantity of evil
capable of being produced by a violation of official duty
depends of course upon the business of the department and
the subdepartment. The department in which the greatest
quantity of evil is in an immediate way so capable of being
produced is the administration department, in virtue of
the defensive force subdepartment or say War-department
which belongs to it and is contained within it.
In the joint proportion of Proportioned to the efficiency of the endeavours capable
of being applied by him to the production of unnecessary war, and
to the value of the remuneration attached to that the success
of those same endeavours will be the probability of war
and the quantity of the evil in all shapes and waste and
depredation in particular produced in the course of it.
