Incurable repugnance
of the constitution to every
one of the ends of
penal justice
confirmed by
2d Collins
So much for as to the law. Now as to the of the measure.
By the deductions of reason drawn reasoning from analogous experience, I had been
led to the persuasion that the institution of this penal Colony
was from the first, and will be to the last in a state of radical
and incurable repugnancy to every one of the objects points that were
or ought to have been the objects of such an institution establishment—to
every one of the ends of penal justice —example—reformation—
incapacitation for first offences—compensation—economy.for the injuries by the penal offences
From the first volume of Captain Collins's Journal those pre
as well as from other equally added to other unprinted but not less authoritative accounts, these
presumptions had received already very ample confirmation.
A continuation of that history to the time of the latest accounts
is just has just made its appearance: and the confirmation
receiv'd from this latest source testimony is ample and conclusive, to a
degree beyond what I myself could have myself imagined.

Individually is
necessary but will
not be granted
without relinquishment.
It appears to me that as soon as the illegality of the
government of N.S. Wales were known or N.S. Wales which
I should take it would be to my business to take care that it should
be, all subordination—all government there would very probably be at an end,
if unless Parliament were to give it that legality which at present
is wanting: but that Parliament would not give it any
such sanction on any other terms than the putting an end
as soon as may be to a system thus replete with misery
and wickedness: both incurable—both in a degree without example.
Were I as careless of hum insensible to human misery and wickedness
as the founders and maintainers of that source of abomination
have shewn themselves for so many years, I should publish the
discovery immediately: As I think that not being the case with
many Being as I am I will be it will be my care, not to let any information transpire
of the disease disorder till Parliament is in a condition to apply the cure
remedy. But to you lawyers it can be no secret that in law as
in chemistry results altogether new may be obtained by a new
combustion of old there would be
To some people the idea would appear an absurdity or
the idea of keeping of keeping secret what has been in print these
four years. The facts certainly have, but the investigation of the
of , and the application of them to a few matters of fact that has
on can one occasion of others.
+ and as they are
always, but too
many the bulk of
the inhabitants
are always ready eager for revolt, even
without any position
or faction could they
be when general disobedience independence
on the part of all was to
would have
be seen to have
the sanction of law—
for though the intelligence
would were not be carried from
there in Vessels under command of government
various other countries receiving intelligence take pass their
they are giving at all times.
