But though no for mutual
wrongs f no satisfaction
due on either side there
may be public wrong
by consumption of
judicial time

Art. But, though it should happen, that for
mutual wrongs in any number, nothing should in the name of
satisfaction should in any shape be found due on either
side to either individual, A wrong to no inconsiderable
amount may in this way have been done by one or
both parties to the public: wrong that is to say by the
consumption made of the judicial time as above

Upon the whole then two distinguishable cases
may on any such occasion require to be taken — two
distinguishable functions require to be exercised by the
Judge: that is to say 1 the conciliator. 2. the punisher
For The conciliator he will to the best of his endeavour ability
give exercise in every case; to the punitive, at the
charge of either or both, if, and in so far as, the circumstances
of the individual case appear to him to
require.
