Definitive 2
momentary
Such ambiguity may be either, 1. definitive,
or 2 momentary
1. In the case where it is definitive, the interpretation
thereby manifested in the diction of the law,
is a serious evil, and constitutes a mischievous vice:
the result of it, on the part of the law, is uncertainty;
on the part of the subject- citizen, correspondent insecurity,
perceived or not perceived.
2. Where the ambiguity is of the momentary
kind merely, no such serious evil ensues. But so long
as it lasts, the result is, on the part of the reader, either
misconception, continuing during the length of time in
question, or a sense of perplexity and embarrassment,
while, instead of the right conception, and the opposite
wrong conception, each fixed upon decidedly, the mind
is hesitating, and as it were vibrating, between the two.

2. Obscurity. of this evil quality in the discourse,
the effect on the mind of the reader, is that instead
of having present to his mind at the same time, two
or more determinate meanings, (of which the proper one
may or may not be one) such that he is in doubt on
which of them to fix, no determinate meaning whatever
is as yet present to his mind.

undesirable and viscious quality, viz. incorrectness.

Of incorrectness, there are three distinguishable
shapes -viz. 1. Redundancy, 2. Deficiency, 3. Entire diversity:
that is to say, on the part of the ideas actually
conveyed by the expression, relation had to the ideas intended
by the author of the discourse to be conveyed.
