<p>In regard to Law-Assistants <add>Helpers</add> a difficulty presents<lb/>
itself and a distinction becomes necessary.  In regard to<lb/>
the case where the Assistant <add>Helper</add> accompanies <del>the</del> <add>his</add> principal<lb/>
in his attendance at the judicatory, no difficulty has<lb/>
place in respect of choice:  whoever the principal<lb/>
himself chooses, whoever in the eyes of the principal is<lb/>
the best qualified <add>most apt</add>, may provisionally at least be <unclear>received</unclear><lb/>
as such:  and if the choice be unfortunate the principal<lb/>
has more to suffer from it than any other person can<lb/>
have.  The only other danger is – waste of the time of<lb/>
the Judicatory in <unclear>important</unclear> discourse:  but an <del>the</del> evil in<lb/>
that shape it depends upon the Judge at any time to<lb/>
put a stop.</p>
<p>Very different is the case where the question is<lb/>
whether the assistant shall be received as a proxy or<lb/>
substitute to the principal:  the <del><gap/></del> having been the <unclear>initiative</unclear><lb/>
one and the principal not in attendance at the<lb/>
same time.  Of the arrangement by which the attendance<lb/>
of the principal on the occasion, so far as obtainable<lb/>
is requisite one main use is the affording to a proposed<lb/>
defendant security against all abuses of the right of<lb/>
<gap/> – of <del><gap/></del> making use of the hand of<lb/>
the Judge to the purpose of imposing on <add>any</add> other person<lb/>
without distinction the vexation and expence incident<lb/>
to the situation of defendant:  and this in a suit <add>case</add> of<lb/>
whatever kind – simply requisite, inculpation is <gap/><lb/>–how annoying so ever may be the means<lb/>
required as necessary to secure eventual <unclear>punibility</unclear> at<lb/>

In regard to Law-Assistants Helpers a difficulty presents
itself and a distinction becomes necessary. In regard to
the case where the Assistant Helper accompanies the his principal
in his attendance at the judicatory, no difficulty has
