Evidence

Introduction
Containing matter common to the subjects of Evidence and
Judicial Procedure.

Ch. 1. Relation of Evidence to Procedure.

The rationale of evidence is but as a branch to the branch, or if not rather as a the kernel to a the nut, to of the rationale
of procedure. Consideration of Attention to the evidence Exhibition or Extraction receipt of evidence, though
a principal operation, is but one out of a number of operations transactions
the which come to be performed demand for which presents itself in the course of a Judicial
Enquiry. By its importance By its importance however, and its distinctness from the rest such however is the comparative
importance, of what relates to this part of the business and so distinct is it this topic in its nature from the rest
its distinctness, and above all the quantity of discourse requisite
for sending it to the bottom, that it a work on this subject
and of such an extent would form a perfect monstrosity could not without palpable incongruity be an of have
been inclosed in the belly bowels of a work on the subject or procedure.
In point of importance, if any comparison in this
respect were not like a comparison in this respect between the belly and the members
respect could be made among the mutually necessary parts of an
aggregate which, it might be a match for all the others put
together. Respecting separation In respect of distinctness, it is so distinct is it from
all details of procedure, as to form quite a separate subject
of inquiry, adapted applicable to a variety of other purposes
and in correspondent variety and suited to the purposes demands exigencies, views and studies of a correspond
other classes of readers. Science in all her branches, Religion
herself, look to rest on evidence as their support: both shrink with horror
from the details labyrinth of judicial procedure.
