Of these costs, the great mass bulk, a comparatively very small portion excepted
are factitious—manufactured by the regular and existing fee
so regularly fee-gathering system: this burthen part of the burthen the
summary system will annihilate. But the greater the
portion amount of this misscaled burthen thus taken off, the greater
is that which, under the name of fine, mulct, or any other name is capable of being sustained by the mala
fide
and the rash suitor: and by operating in the way
of determent distraction, delivering ill-disposed the ill-disposed persons from setting
up unjust demands, and unjust defences every penny
thus extracted demanded will instead of the demand have the effect
of shutting the door—not against justice but against injustice.
