1. Jurisdiction by reason of affection to a place, and in particular by reason of birth. 1. As to Jurisdiction by reason of affection to a place.
The circumstance of a man's having an affection to any place
within the dominions of his own state gives that state a
means of influencing his conduct in as far as banishment
from that place happens to be a punishment to him. Now
it generally happens that a man's affection for his native
soil is stronger than his affection for any other place.
Jurisdiction by reason of birth is therefore in general more
conspicuous and more coercive than any other kind of jurisdiction
resulting from affection. In particular cases however
it may prove less coercive.

2— by reason of Residence. 2. As to Jurisdiction by reason of residence. The circumstance
of a man's being resident in one's own state gives that state
a means of influencing his conduct in as far as any kind
of corporal punishment can affect him: provided his person
can be apprehended.
