Of Excuses Extenuations
heedlessness is to a want of consciousness. See Excuses 1.
Heedlessness what Heedlessness consists in the not being conscious of a material
circumstance which really exists, where there are
good or probable grounds for suspecting it to exist.
Rashness consists in the supposing a circumstance
which, had it existed, would have been material to
exist where there were no good or probable grounds
for supposing it to exist entertaining such a supposition.

In either case, the Mis- supposal may have respect
either to the matter of fact (A)or the matter of Law. It respects
the matter of fact when the mistake is concerning
the existence of a fact or circumstance on which
you rely for your Justifiation. It respects the matter
of Law, when the mistake is concerning the existence
or import of a Law (B), or rule of unwritten (C) Law, which
you suppose to have established the fact or circumstance
in question as a ground of Justification.
