Bentham on Evidence by Dumont Announcement
Italy
We know not exactly to what causes it is to be ascribed
but it is remarkable & as far as it goes a gratifying fact
that in Tuscany the Press has never been altogether in so enslaved a
state as in the rest of Italy under the yoke of Austrian domination.
One obvious cause is, that tho' always under the government
of the Imperial family it is even to this time been
a sort of separate tho' dependent State: & tho' in respect of
foreign relations & military power always at the command
of the head of the family, to a considerable degree it seems to him as yet distinct
& unfettered in respect to its internal government:
a circumstance which under under so grinding and stupid stupefying a domination, this degree of comparative liberty & good government is matter of no small
surprise. Few proofs of it would be more remarkable &
conclusive than the existence of a Journal which at this
time of day could dare to speak of Mr Bentham by any
such title as of the Newton of Legislation

The following is a passage in a letter from Mr
Dumont (the celebrated Editor of those of Mr Bentham's works which were
originally in French) to a friend in England.
There comes out at present at Florence Miscellany
(Antologi it is called) in which has just now been inserted a translation
of a chapter of Mr Bentham's work on Evidence, which I
had communicated to the "Annals of Legislation" published at
Geneva. I am surprised that It is not without surprise that I can see a Government subject to the immediate
influence of Austria should have suffered thus suffering the appearance
of an article such as the one in question; accompanied as it is by the excellent
notes of Rossi whose name is very so far from being
in good political odour either at Milan or Rome. The work on Evidence
