As to the humanity in this shape it was t'other day and but t'other
day it was done away. Wisdom and humanity remain and
seem destined to perseverance.

When whatever it be for the purpose of compensation
or for the purpose of punishment a mans property or any
part of it is to be taken from him, common sense would
say let it by an appropriate desire let the Judge take it
from him — the thing is done. Not in Common Law.
Such is its tenderness for the patient in this case, as in
that of pure fate it does not without his own consent
will it produce it at his charge the effect of compliance:
not without his signature to an instrument of conveyance. To
produce the compliance which is the operation it performs upon
