The distinction between real security and apparent
or real security the sense of security or what
comes to the same thing between real security and
apparent is nothing less than a mere speculative
one: its importance may be made sensible by
a striking example. In England upon a moderate competitive three fourths
at least of the thefts and robberies that are committed escape
trial: and of those that are tried one half at least
escape punishment: all, as I shall have occasion to
shew hereafter owing to the necessary effect of various
imperfections in the law. Suppose a the judge, without
authority from the law, were to apply proper were
to these defects, but by powers of his own usurpation
and without authority from the law: and
that the number of thefts and robberies those crimes was diminished
in consequence. Suppose too that the authority
usurped by him for the purpose was exercised
by him without any other view: that the usurpation
extended itself to no further: that it did not appear usurpation
