Real

Now on to the subject matter of this same Law
of real property: that is to say that which would to its subject matter the subject matter which it
would have if it had existence.

If instead of Real property the words had been
property in immoveable subjects subject matter, or for directness property
in immoveable, I should have understo every body
would have had some conception of what was meant
and consequently of the number: though even in that
case a natural question would have presented obtruded itself to
wit why whereas there are two other of subject matter of
property there are two others, to wit moveable, and incorporeal
why of the three it has happened to on the occasion in question this one to be the sole object
of the legislators his Majestys advisers care.

Coupled with existence must be understood as an
indispensable adjunct intelligibility. If Of that to which
the force of law is given, the language were no other than
that which is in use in China, it would not the less in
existence the property of existence would not the less belong
to it, but in who do not understand Chinese should not
be much the better for it.

In technical language real is put in contradistinction
to personal: and all things being having been declared
the subject matters of property all things are declared to
be either real or personal. Witness Blackstone whose
dicta form part and parcel of the imaginary being called or nothing
else does.
