of injustice from this arrangement can with reason be<lb/>

misdecision <del>only</del> <add>only</add>, simple misdecision, pure from mala fides,<lb/>
the Judge below may be trusted <add>supposing the point given him</add>, for taking such measure<lb/>
of precaution as <del>shall</del> in case <add>the event</add> of misdecision,<lb/>
so pronounced by the Court above, shall prevent the mischief<lb/>
from being irreparable.</p>
<p>I find <del>some</del> difficulty in conceiving that Court of<lb/>
justice, be the Judge ever so mean and ignorant, on whose<lb/>
part such mala fides can with consistency be presumed.<lb/>
At any rate, of no Court can it be presumed but of that<lb/>
of the very lowest and least untrustworthy class whatsoever that<lb/>
be.</p>
<p>But in Scotland – in the Court of Sessions, my Lord?<lb/>
in England, in any one of the great Courts in Westminster Hall<lb/>
is <del>that</del> the supposition of that sort <add>and degree</add> of untrustworthiness for a<lb/>
single moment so much as endurable.</p>

Be pleased, my Lord, to observe, that it is only in
case of mala fides on the part of the Judge, that the danger
of injustice from this arrangement can with reason be
set down as deemed the amount to anything. For suppose danger of
misdecision only only, simple misdecision, pure from mala fides,
the Judge below may be trusted supposing the point given him, for taking such measure
of precaution as shall in case the event of misdecision,
so pronounced by the Court above, shall prevent the mischief
from being irreparable.

I find some difficulty in conceiving that Court of
justice, be the Judge ever so mean and ignorant, on whose
part such mala fides can with consistency be presumed.
At any rate, of no Court can it be presumed but of that

be.
