But what I do regard as probable is that
on the an occasion such as the above mentioned, and in
any high situation similar to that in which the said
Mr Percival is placed stands as above mentioned, viz. that
of having an annuity dependent on the continuation
of to take effect from the commencement of a war
even though instead of 38,000 such annuity were no more than
£3,000 or even no more than £380, any more – other than the said nay even any
great character other than the said Mr Percival –
would on the occasion above mentioned be influenced.

For, upon the most diligent search made in
the Books, I have not although I find it laid
down by the great Lord Coke, in his famous case the famosis libellis, that to speak I should say have said
to write will of Magistrates (innuendo great characters
in high situations) that were once in esse, but
now are dead, is or may be a libel, and for that for the reason that forasmuch as Magistrates
never dies, yet how I not been able to find either
a decision or so much as a single dictum from
any Bench or so much much as any Bar, imparting
that it is in the power of a man
to be guilty of publishing a libel by words
written of and concerning a great character not
yet in esse: and to wit that as for and in respect of a
future state contingent state of mind, a
state of mind which in the case of the individual in
question has not at the time of writing been realized,
and by to which possibility may it may never come to be
realized.
