<p>1.  Because, taking the fact <add>of the extenuation</add> for granted, the punishment<lb/> must be inefficaceous.  See Introd. Ch [Cases <unclear>unusual</unclear> <del><gap/></del>]<lb/></p> <p>2.  Because it distracts from the secondary mischief<lb/> of the offence:  from the alarm and from the<lb/> danger.  From a man's being in such<lb/> necessity at one time it follows not that he will<lb/> be in the same necessity continually: and from<lb/> his stealing <del>when</del> <add>at a time that</add> he has this motive to urge<lb/> him it follows not that he will steal when<lb/> he has it not.</p>

1. Because, taking the fact of the extenuation for granted, the punishment
