<p>Note on the word <hi rend="underline">proposed</hi>. Supposing<lb/>
the ends of justice the ends aimed at. Note on this occasion<lb/>
the indispensable need of it, in addition to the<lb/>
several terms <hi rend="underline">plaintiff</hi> or <hi rend="underline">pursuer</hi> and <hi rend="underline">defendant</hi>.<lb/>
Under the existing system, no such distinction has place.<lb/>
How so? Answer. Because, as to the plaintiff's side,<lb/>
without need of special allowance from the Judge,</p>
<p>To act in this character is every man that<lb/>
pleased. Be they who they may, and in what number<lb/>
they may, every man whose wish it is to torment,<lb/>
and wherever there is not money enough for<lb/>
going on with the defence, to ruin any other man or<lb/>
any number of men, is received with open arms:<lb/>
the price for the writ being paid, and in this same<lb/>
way, each succeeding operation performed and instrument<lb/>
delivered in, the whole process goes on of course:<lb/>
every person who proposes himself for plaintiff is received<lb/>
as such, as a customer is at any other shop-<lb/>
no questions asked; and thus is made to evaporate the<lb/>
distinction between actual and proposed plaintiff.</p>
<p>On the other hand, every man in relation<lb/>
to whom any other man, by so becoming plaintiff, has<lb/>
required that he should be put to the alternative<lb/>
of either rendering the service demanded by the said<lb/>
plaintiff at his charge, or by contesting the plaintiffs<lb/>
right to such service so demanded, act in the character<lb/>
of Defendant, is forced either to act in that<lb/>
character, or submit to the burthen, whatever it be,<lb/>
thus sought to be imposed upon him: and thus<lb/>
is made to evaporate the distinction between actual<lb/>
and proposed Defendant.</p>
