Petition for Justice
On the other hand, in every system in
which it is an object to preserve men in both situations
from injury - no man being received to act as
plaintiff but upon some ground, of the propriety of which
the Judge has become satisfied, nor any man considered
and spoken of as being a Defendant, till by some
act of his he has shown that he is so, the distinction
marked, in both cases, by the word proposed, is in indispensable
one.
Under the existing system, on the one
hand, to confound all things that should be distinguished
on the other hand to establish distinctions, where
there are no differences is, as will be seen, an all
pervading practice
