Attorney had to draw up a <hi rend="underline">case</hi>, from<lb/>
this <hi rend="underline">Case</hi> an Advocate, stiled a <hi rend="underline">Serjeant</hi><lb/>
<hi rend="underline">Contour</hi>, afterwards simply Serjeant,<lb/>
(Barristers originally stiled <hi rend="underline">Apprentices</hi><lb/>
were not hatched) had to draw up<lb/>
the pleading, commencing with that<lb/>
stiled, as above , the <hi rend="underline">declaration</hi>. Attached<lb/>
to each of these learned persons was his<lb/>
Clerk: Masters and Clerks by each one of<lb/>
them was received his fees.</p>


<p>Father of a family! when you<lb/>
have a dispute to settle between two of<lb/>
your Children, do you ever begin by driving<lb/>
them from your presence? do you send<lb/>
them to Attorney, Special Pleader, Serjeant<lb/>
or Barrister? Think you that by<lb/>
any such assistance, any better chance<lb/>
would be afforded you for coming at the<lb/>
truth, than by hearing what the parties<lb/>
had to say for themselves?</p>
<p>The Judge was a Shop-Keeper.<lb/>
A curious article, stampt with the<lb/>
name of <hi rend="underline">justice</hi>, the commodity he<lb/>
dealt in. By hearing the applicant the<lb/>
would be Plaintiff in person, nothing</p>

lose, a suit was defending, the Judges<lb/>
on each occasion at the instance of the<lb/>
Defendant, sent to the how-soever distant<lb/>
Judicatory in order to proceed no further,<lb/>
and to the Defendant, an order to come,<lb/>
and, along with the Plaintiff add himself<lb/>
to the train, as above. This having<lb/>
been made the practice, and been extensively<lb/>
felt and universally seen to be so, thus<lb/>
all over the Kingdom was an end put<lb/>
to the business of all the English speaking<lb/>
and Justice administering Judicatories</p>
<p>If a man, who was rich enough,<lb/>
beheld within the jurisdiction of one of<lb/>
those judicatories another whom, by enmity<lb/>
or any other cause, he was disposed to<lb/>
ruin, all he had to do was to commence<lb/>
a suit, either in the great traveling Judicatory,<lb/>
or in the first instance in the little<lb/>
fixt Judicatory, and thence call it up<lb/>
into this all devouring one.</p>
<p>Appeal, on such occasions, does<lb/>
good service: the practice, (<hi rend="underline">evocation</hi> in<lb/>
French it is called) was, any body may<lb/>
see to how great a degree, an improvement<lb/>
upon it.</p>
