It may be of use to produce in each case an example
to shew that in Personation and Forgery it is
not the characteristic fact taken by itself that can
be material, and that therefore notwithstanding the
narrowness of that fact these two species of falshood
are as extensive and as variable as any either of
the two others. For by that means it will apppear
that all four species of falshood are equal alike
capable of running through the whole system of possible
mischief and possible offences: And which will shew
the propriety where it will appear that equal
provision ought to be made for the intervention of
every one of these circumstances under the head
of every offence.


There is one head of distinction to which they are all
alike subject and that under every head of possible
delinquency which is this. Either they are essential to the
constitution of the offence or they are not. They are
partial to the constitution of the offence, when the
effects first it is calculated to produce can not be produced by any other means:
they are not essential to it where those effects may
indeed be produced by these mans: but at the same time
there are also other means by which it may be produced without
