Evidence
A systematical plan of depredation in this
way being in point of fact thus unexampled
notwithstanding the apparent opening for this
made in so many instances for the accomplishment
of it, it remains to be considered
to what circumstances causes this abstinence may with the
greatest probability be ascribed.
1. In this view, the first circumstance this
presents itself, is – the natural ground of suspicion
to which the agent in a plan this sort could
not fail at the very first glance to perceive
himself exposed. The prejudice of the Judge is against
him: & by the supposition so is the truth itself: truth
& opinion, such are the ir antagonists he finds
opposing him at every step.
2d. A more feasible plan – a less unsafe
plan – so far as safety or any tolerable prospect
of safety can be conceived to attach itself to any
such partnership in guilt would be the forming
a sort of partnership connection with another individual
for the purpose of carrying on the supposed
trade of false evidence upon a plan analogous to
that already stated as being probably pursued by
informers who under protection & by the invitation of the
law engage in a trade already spoken of as carried on by the means of true evidence.
